Terms of Service

These terms cover your use of toori.ai and any account you create there. By creating an account you agree to them. If you don't, don't create one.
Who you're dealing with
Toori, Inc. is a company registered in California, based in San Jose. In these terms, “Toori”, “we”, and “us” mean Toori, Inc. “You” means the person using the site or holding an account, and the business you represent.
What Toori is
Toori is an AI phone answering service for small businesses. It answers calls you can't get to, takes messages, answers common questions, books appointments, and alerts you when something is urgent — based on the information you give us when you set it up.
The phone service is not switched on yet. Today you can create an account and complete the setup form. No calls are being answered. When the service becomes available, we will tell you, and you'll agree to a service agreement covering how it runs before anything is switched on for your business.
Your account
- You need to be at least 18 and able to enter a contract.
- Keep your login details to yourself. You're responsible for what happens under your account.
- Tell us promptly if you think someone else has got into it.
- One account per business. Don't create an account on behalf of a business you're not authorised to represent.
The information you give us
The agent is only as good as what you tell it. You're responsible for the accuracy of the business information you enter — your hours, your prices, your services, what counts as urgent. If your setup answers are wrong, the agent will confidently repeat them to your customers.
You also confirm that you have the authority to let Toori answer calls on behalf of the business you've named, and to forward its phone line if you choose to.
Recorded calls
When the phone service launches, calls answered on your behalf may be recorded and transcribed so the agent can take messages and book appointments.
California and a number of other states require that everyone on a call is told it's being recorded. Toori will state this at the start of every call it answers. You remain responsible for making sure your own use of the service is lawful where your business and your customers are located.
Detailed terms covering recording, consent, retention, and who is responsible for what will form part of the service agreement you accept before the service is enabled for your business. Nothing in this section applies until then, because no calls are being answered.
Acceptable use
Don't use Toori to:
- Break the law, or help anyone else break it.
- Misrepresent who your business is or what it does.
- Make unsolicited marketing calls, or anything that would breach telemarketing rules.
- Harass, threaten, defraud, or impersonate anyone.
- Attack, overload, reverse-engineer, or probe our systems.
- Scrape the site, or resell the service as your own without a written agreement.
We can suspend or close an account that does any of these.
What it costs
Toori is free to use at the moment. There is no paid plan yet and nobody is being charged.
When we introduce pricing we'll publish it, and it will work the way we've advertised it: no setup fee, billed monthly, no minimum term, cancel whenever you want. You'll be told before you're ever charged anything, and you'll have to actively agree to it. We won't turn a free account into a paid one on its own.
Cancelling
Close your account whenever you like — email hello@toori.ai and we'll do it. Your data is deleted as described in the Privacy Policy. If you're on a paid plan when that happens, service runs to the end of the period you've paid for.
We can close your account too, if you break these terms, or with reasonable notice if we stop offering the service.
Availability
We work to keep Toori running, but we don't promise it will be available without interruption. Software has outages, phone networks have outages, and the services we build on can go down. We'll tell you about planned maintenance where we can.
The service is provided as-is. We don't warrant that it will be uninterrupted, error-free, or that the agent will handle every call the way you'd have handled it yourself. Toori is a tool that answers calls you would otherwise have missed. It is not a substitute for professional advice, an emergency service, or a human employee, and it should not be relied on for anything where a missed or mishandled call would be dangerous.
Limits on what we're liable for
To the fullest extent the law allows, Toori is not liable for indirect, incidental, or consequential losses — including lost business, lost revenue, lost customers, or reputational harm — arising from your use of the service.
Where we are liable, our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars.
Nothing here excludes liability that can't lawfully be excluded.
Your responsibility to us
If a claim is brought against Toori because of how you used the service — including the accuracy of the information you gave us, or your compliance with laws that apply to your business — you agree to cover the reasonable costs of dealing with it.
Changes
We may change the service and these terms. When we change the terms we'll update the date at the top, and for anything material we'll email account holders rather than leave you to find it. Carrying on using Toori after a change means you accept it. If you don't, close your account.
Which law applies
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute goes to the state or federal courts located in Santa Clara County, California, and both of us agree to that.
The rest
If any part of these terms turns out to be unenforceable, the rest still stands. If we don't enforce something straight away, that doesn't mean we've given it up. You can't transfer your account or these terms to someone else without our agreement; we can transfer them if the company is acquired or reorganised. These terms and the Privacy Policy are the whole agreement between us about the site and your account.
